WAL-MART HATCHET SUSPECT Attacker committed to Rusk State Hospital Robin Y. Richardson ryrichardson@marshallnewsmessenger. Christopher Lynn Hamilton, the suspect charged with attacking two local Wal-Mart associates and a customer with a hatchet, was ordered on Monday to be placed into the custody of Rusk State Hospital for a period of no more than 120 days. The order, agreed upon by the district attorney’s office and Hamilton’s court-appointed attorney Kyle Dansby, was approved by 71st District Judge Brad Morin during a competency hearing, set as a result of a psychologist’s recommendation stating that Hamilton wasn’t competent enough to stand trial. “The court further finds that Christopher Lynn Hamilton is a danger to others and public safety,” the order, signed by Judge Morin, states. The order noted that the court reviewed the psychiatric evaluation of Hamilton prepared by Dr. Thomas Allen on March 14. “Dr. Allen diagnosed Hamilton as suffering from a mental illness: schizophrenia paranoid type,” the order states. “Due to defendant’s mental illness, Dr. Allen concluded that defendant is not competent to stand trial or be an aide to his attorney at the present time. “It is ordered, adjudged, and decreed that all criminal charges against defendant have not been dismissed, that there is evidence that (the) defendant is mentally incompetent, and that (the) defendant requires commitment to a mental health facility,” the order states. According to the order, Hamilton will be transported to the facility by the sheriff’s department. The court ordered that the facility develops an individual program of treatment for Hamilton while he’s there; assess and evaluate whether the defendant will obtain competency in the foreseeable future, and report to the court and to the local mental health authority or to the local mental retardation on Hamilton’s progress toward achieving competency. “It is further ordered that if the defendant is committed to an impatient mental health facility or to a residential care facility, the facility shall report to the court at least once during the commitment period,” the order states. When Hamilton is discharged and returned to the court, the court will determine his competency to stand trial. If he is found competent to stand trial, criminal proceedings against him may be resumed, the order states. Hamilton, an Arkansas transient, was arrested on Dec. 9 and charged with three counts of aggravated assault with a deadly weapon, after allegedly coming into the Wal-Mart in Marshall and attacking two of the store’s associates and a customer with a hatchet. A Harrison County grand jury indicted him earlier this month on three counts of aggravated assault with a deadly weapon in connection with the incident. His attorney, Dansby, filed a motion in January suggesting incompetency and request for examination. He explained in the motion that he was unable to prepare a defense for his client because he wouldn’t speak with him about the facts surrounding the allegations of the offense. Further, Hamilton mentioned a potential mental condition to him, but wouldn’t disclose to him the treatments, diagnosis, or all medications that he had previously taken.
